Terms of service

These terms cover use of fenna.tech’s secure upload portal, including the live General Movements Assessment Parent Upload Portal built with the Developmental Disabilities Association (DDA).

By using the portal — as staff, as someone uploading a file through a link, or as an organization evaluating a tailored deployment — you agree to these terms.

The service

The portal provides:

  • temporary, typically single-use upload links
  • an admin console for allowlisted staff
  • delivery of uploaded files into cloud storage the organization connects
  • optional email notifications when uploads complete

It is not a full electronic medical record, video editing tool, or general file-sharing platform.

Who may use it

  • Organizations may use a deployment they have arranged with fenna.tech, subject to any separate agreement.
  • Staff may use the admin console only with an allowlisted account and only for legitimate organizational purposes.
  • Parents and other uploaders may use a link solely to submit the requested file for the person and purpose the link was created for.

Do not share a parent link publicly or with people who should not receive it.

Acceptable use

You agree not to:

  • upload unlawful, harmful, or unrelated content
  • attempt to access another person’s link, data, or admin areas without authorization
  • probe, overload, or disrupt the service
  • reverse engineer the service except where applicable law allows
  • use the portal to spam or send unsolicited bulk communications

Organizations are responsible for how they configure the portal, who they allowlist, which storage they connect, and how they handle files after upload.

Files and ownership

  • Uploaded files are intended for the receiving organization.
  • Organizations are responsible for their own retention, access control, and clinical or business use of those files.
  • fenna.tech does not claim ownership of clinical content you upload or store through the portal.

Privacy

How information is handled is described in the Privacy statement. That statement is part of how we operate the service.

Availability and changes

We aim to keep the portal reliable, but we do not guarantee uninterrupted availability. Features, wording, and hosting details may change as we improve the product. We may suspend access that appears abusive or insecure.

No medical advice

Nothing in the portal is medical advice. Clinical decisions remain with qualified professionals and the organizations that use the system.

Disclaimers

The portal is provided as is and as available, to the fullest extent permitted by law. fenna.tech disclaims warranties of merchantability, fitness for a particular purpose, and non-infringement, except where such disclaimers are not allowed.

Limitation of liability

To the fullest extent permitted by law, fenna.tech and Marcus Fan are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost data, lost profits, or business interruption arising from use of the portal. Where liability cannot be excluded, it is limited to the greater of (a) fees paid to fenna.tech for the service in the three months before the claim, or (b) CAD $100.

We may update these terms. The current version is published in these docs. Continued use after updates means you accept the revised terms.
